These Terms of Service (“Terms”) govern your access to and use of the OwnRyde mobile application, website, and services (the “Platform”), operated by OwnRyde, Inc. (“OwnRyde,” “we,” “us,” or “our”).

By creating an account or using the Platform, you (“User,” “Member,” “Driver Member,” or “Rider Member”) agree to be bound by these Terms.

OwnRyde is NOT a Transportation Network Company (TNC).
OwnRyde is a Private Membership Transportation Platform.
Membership approval is required to access any feature of the Platform.

1. About OwnRyde

OwnRyde provides a private, member-only software Platform that connects Rider Members seeking pre-arranged transportation with Driver Members who independently provide such transportation.

OwnRyde does not:

• Provide transportation services
• Employ drivers
• Own or operate vehicles
• Control driver behavior
• Guarantee transportation availability

All transportation services are provided exclusively by independent Driver Members.

2. Membership Requirement

Access to OwnRyde requires approval as a Rider Member or Driver Member.

OwnRyde reserves the right to approve, deny, or revoke membership at its sole discretion, including for safety concerns, fraud, incomplete documentation, unacceptable behavior, or policy violations.

3. Eligibility

• At least 18 years old for Rider Members
• At least 21 years old for Driver Members
• Completion of identity verification
• Use of legal name and accurate information
• Not previously banned from the Platform

4. Nature of the Platform

• OwnRyde is a technology platform
• Facilitates communication between Members
• Does not provide transportation services
• Does not assume responsibility for rides
• Does not manage or supervise Drivers
• Is not liable for Member conduct

All ride arrangements are private agreements between Members.

5. User Accounts

• Provide accurate and current information
• Maintain the security of login credentials
• Not create multiple accounts
• Not allow others to use your account
• Report unauthorized access immediately

Accounts may be suspended for suspicious activity.

6. Rider Member Responsibilities

• Treat Driver Members respectfully
• Follow safety guidelines
• Avoid illegal activity
• Not bring prohibited items
• Pay for all completed rides
• Maintain valid payment information
• Not damage vehicles

7. Driver Member Responsibilities

• Maintain required commercial or rideshare-endorsed insurance
• Keep vehicles safe and clean
• Follow all applicable laws
• Maintain documentation and background checks
• Provide professional and safe service
• Report accidents immediately

8. Payments

Rider Members authorize automatic ride charges, applicable fees, cancellation fees, and adjustments processed through Stripe.

Driver Members authorize payout processing and platform fee deductions via Stripe.

OwnRyde does not store credit card information.

9. Prohibited Activities

• Unlawful conduct or fraud
• Abuse, harassment, or threats
• Transporting weapons or illegal substances
• Off-platform or cash rides
• False accounts or information
• Platform interference or misuse

Violations may result in immediate termination.

10. Safety & Incidents

OwnRyde provides emergency tools, reporting systems, and review features; however, safety cannot be guaranteed.

Users must immediately report accidents, injuries, criminal conduct, or policy violations.

11. Insurance

OwnRyde does not provide insurance to Drivers, Riders, vehicles, or third parties.

All transportation is performed by Driver Members operating under their own insurance policies.

12. Disclaimers

The Platform is provided “as is.” OwnRyde makes no warranties regarding safety, reliability, availability, or Member conduct.

13. Limitation of Liability

OwnRyde is not liable for injuries, death, property damage, lost income, vehicle damage, emotional distress, insurance disputes, or incidents during rides.

Your sole remedy is discontinuing use of the Platform.

14. Indemnification

You agree to indemnify and hold OwnRyde harmless from all claims, damages, losses, liabilities, costs, and legal fees arising from your use of the Platform or violations of these Terms.

15. Termination

OwnRyde may suspend or terminate accounts for unsafe conduct, illegal activity, fraud, harassment, false information, insurance lapses, or non-compliance.

Members may terminate accounts at any time.

16. Privacy

Use of the Platform is subject to the OwnRyde Privacy Policy.

17. Arbitration Agreement

All disputes must be resolved through binding arbitration in Oregon. Class or collective claims are not permitted.

18. Changes to These Terms

OwnRyde may update these Terms at any time. Continued use signifies acceptance.

20. Acceptance
